Class X Felony Drug Cases
The following offenses are all Class X felonies. Generally, class X felonies involve mandatory prison with a sentencing range of 6 to 30 years in the Illinois Department of Corrections. Class 1 Felony Drug Cases
The following offenses are all Class 1 felonies. Generally, class 1 felonies are probationable. Some of the offenses on this list, however, involve mandatory prison with a sentencing range of 4 to 15 years in the Illinois Department of Corrections. There are other circumstances that could also effect the sentence you receive on Class 1 felonies, like if you were on felony probation or the drug was mixed with fentanyl.
- Delivery of a Controlled Substance (1 to 15 grams) – 720 ILCS 570/401(c)(2)
- Delivery of a Controlled Substance within 500 feet of Protected Property (school, church, nursing home, etc.) – 720 ILCS 570/407
- Delivery of Methamphetamine (5 to 15 grams) – 720 ILCS 646/55(a)(2)(B)
- Possession of a Controlled Substance with Intent to Deliver (1 to 15 grams) – 720 ILCS 570/401(c)(2)
- Possession of a Controlled Substance (over 15 grams) – 720 ILCS 570/402(a)
- Possession of Cannabis (5,000+ grams) – 720 ILCS 550/4(g)
- Possession of Methamphetamine (15 to 100 grams) – 720 ILCS 646/60(b)(3)
Class 2 Felony Drug Cases
The following offenses are all Class 2 felonies. Generally, class 2 felonies are probationable. Some of the offenses on this list, however, could involve mandatory prison with a sentencing range of 3 to 7 years in the Illinois Department of Corrections. Your sentencing range could be different based on the facts and circumstances of your case.
- Delivery of a Controlled Substance (Less than 1 gram) – 720 ILCS 570/401(d)
- Delivery or Possession with Intent to Deliver less than 5 grams of LSD or Ecstasy – 720 ILCS 570/401(d)
- Delivery or Possession with Intent to Deliver less than 5 grams of Methamphetamine – 720 ILCS 646/55(a)(2)(A)
- Possession of Cannabis (2,000 to 5,000 grams) – 720 ILCS 550/4(f)
- Possession of Methamphetamine (5 to 15 grams) – 720 ILCS 646/60(b)(2)
- Possession with Intent to Deliver a Controlled Substance (Less than 1 gram) – 720 ILCS 570/401(d)
Class 3 Felony Drug Cases
The following offenses are all Class 3 felonies. Generally, class 3 felonies are probationable. If sentenced to the Department of Corrections, the sentencing range of 2 to 5 years. Your sentencing range could be different based on the facts and circumstances of your case.
- Delivery of Prescription Drugs – 720 ILCS 5/17-3(a)
- Possession of Cannabis (500 to 2,000 grams) – 720 ILCS 550/4(e)
- Possession of Cannabis (2nd Offense) (100 to 500 grams) – 720 ILCS 550/4(d)
- Possession of Methamphetamine – 720 ILCS 5/19-1(b)
- Unauthorized Possession of Prescription Form (2nd Offense) – 720 ILCS 570/406.2
Class 4 Felony Drug Cases
The following offenses are all Class 4 felonies. Class 4 felonies are probationable. If sentenced to the Department of Corrections, the sentencing range of 1 to 3 years. Your sentencing range could be 1 to 6 years based on the facts and circumstances of your case.
- Possession of a Controlled Substance – 720 ILCS 570/402 (c)
- Possession of Cannabis (100 to 500 grams) – 720 ILCS 550/4(d)
- Possession of Cannabis (2nd Offense) (30 to 100 grams) – 720 ILCS 550/4(c)
- Unauthorized Possession of Prescription Form – 720 ILCS 570/406.2
Class A Misdemeanor Drug Cases
The following offenses are all Class A Misdemeanors. Class A Misdemeanors are supervision and probation eligible. However, you could be sentenced up to 364 in the county jail.
- Possession of Cannabis (30 to 100 grams) – 720 ILCS 550/4(c)
- Possession of Cannabis in a Motor Vehicle – 625 ILCS 5/11-502.15
- Possession of Drug Paraphernalia – 720 ILCS 600/3.5
- Attempt Possession of a Controlled Substance or Methamphetamine – 720 ILCS 5/8-4
- Attempt Unauthorized Possession of Prescription Form – 720 ILCS 5/8-4
Class B Misdemeanor Drug Cases
The following offenses are all Class B Misdemeanors. Class B Misdemeanors are supervision and probation eligible. However, you could be sentenced up to 6 months in the county jail.
- Possession of Cannabis (10 to 30 grams) – 720 ILCS 550/4(b)
Petty Drug Cases
The following offenses are all Petty Offenses (fine only cases). Petty offenses are supervision and probation eligible.
- Possession of Cannabis (less than 10 grams) – 720 ILCS 550/4(a)
